Restructuración del sistema contractual boliviano (Investigación 1: voluntad negocial)

Resumen:El objeto de estudio de la presente investigación es la voluntad negocial desde un método hermenéutico-evolutivo catalizado para la realidad actual del orden jurídico boliviano y la sociedad que atiende. El objetivo es develar la estructura doctrinal apta para que en conjunción con los Principios UNIDROIT (2010) sobre los contratos comerciales internacionales y la Constitución Política del Estado puedan realizarse restructuraciones en el sistema contractual boliviano para contribuir a la seguridad jurídica, velando por el equilibrio en los contratos. Esta es la primera investigación de cuatro a ser realizadas con el mismo propósito.

Abstract:The purpose of the present research is to catalyze the business will from a hermeneutic-evolutionary approach for the current reality of Bolivian legal system and society. The goal is to uncover the suitable doctrinal structure in conjunction with the UNIDROIT Principles (2010) of the International Commercial Contracts and the State Constitution thus restructuring can take place in de Bolivian contractual system to contribute to legal certainty, ensuring a balance in contracts. This is the first investigation of four to be made for the same purpose.
